We Take Your Privacy Seriously

We've recently updated our Privacy Policy and Terms & Conditions, in accordance with the General Data Protection Regulation (GDPR) passed by the European Union (EU), which requires your explicit consent to send you non-transactional communication.

Even if you reside outside the EU, privacy protection is good practice and the same procedures will be implemented for all users of Projecis. This privacy notice discloses the privacy practices for www.projecis.com and any other sites ("Site(s)") developed by Projecis, Inc, a California corporation ("Projecis") in the future. This privacy notice applies solely to information collected by the Sites. It will notify you of the following:

  1. What personally identifiable information is collected from Users and Members through the Sites, how it is used and with whom it may be shared.
  2. What choices are available to you regarding the use of your data.
  3. The security procedures in place to protect the misuse of your information.
  4. How you can correct any inaccuracies in the information.

User and Member privacy is important to Projecis. This privacy policy ("Policy") applies to the Projecis Sites and the Projecis Services, as detailed in the Terms and Conditions, and tells you how personal information is collected, used, disclosed, and protected by Projecis. All capitalized terms not defined in this Policy shall have the same definition as in the Terms and Conditions posted on the Site.

Changes to This Policy

This Policy may be changed from time to time. If there are material changes to this Policy, Projecis will notify its Members directly. We encourage Members to check this Policy whenever they use the Site and Services to understand how personal information is used.

Information Collected

We collect information from Users in various ways when they use our Web sites and services. We may also supplement this information with information from other companies. We collect two general types of information, namely personal information and aggregate data. As used in this Policy, the term "personal information" means information that specifically identifies an individual (such as a name and email address), and demographic and other information when directly linked to information that can identify an individual.

Our definition of personal information does not include "aggregate" data. Aggregate data is information we collect about a group or category of Services or Members from which individual Member identities have been removed. In other words, no personal information is included in aggregate data. Aggregate data helps us understand trends in our Members' needs so that we can better consider new features or otherwise tailor our services. This Policy in no way restricts or limits our collection and use of aggregate data, and we may share aggregate data about our Members with third parties for various purposes, including to help us better understand our customer needs and improve our services and for advertising and marketing purposes.

The legal basis for this processing is the proper administration of our website and business and our legitimate interests, namely monitoring and improving our website and services and the proper management of our customer relationship. In addition, we may process personal information where necessary for the establishment, exercise or defense of legal claims. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

Projecis utilizes personal information in order for other members on your team to identify you and communicate with you through the system. Some examples of this information include first name, last name, telephone number(s), and email(s). This communication includes notifying you of changes to Projecis projects of which you are a member. This information is also used by Projecis to notify you of important information.

Ways we use your private information:

The following are the specific types of information we collect from Users:

  1. Information Users Give Us. We collect information Users give us on the Site and when they register for and use the Services. Examples include the following:
    1. Registration and Profile Information. When Users register to use our Services or update their profile, we may collect various kinds of information about Users including, name and email address; title, company and other profile information Users provide; demographic information; and information uploaded like photos, telephone numbers, files, and documents.
    2. Contact Information. We collect the email addresses Members provide for contacts Members enter or upload into their private contacts page. When Members choose to collaborate or share files with others, we also collect email addresses provided for email invitations to those individuals on the Members behalf.
    3. Payment Information. Since the license to use the Projecis Site is paid by credit card, our payment processing vendor collects Member credit card information and billing address.
    4. Submissions and Customer Service. From time to time we may use surveys, contests or sweepstakes requesting personal or demographic information and customer feedback.
  2. Automatically Collected Information. We automatically receive certain types of information when Users interact with our Web pages, services and communications. For example, it is standard for the User's Web browser to automatically send information to every Web site the User visits, including ours. That information includes the computer's IP address, access times, the browser type and language, and referring Web site addresses. We may also collect information about the type of operating system uses, account activity, and files and pages accessed or used by the User.
  3. Cookies and Web Beacons. We may also use certain kinds of technology such as cookies and Web beacons to collect information. Among other things, the use of cookies and Web beacons enables us to improve our Web sites and emails by seeing which areas and features are most popular, to count the number of computers accessing our Web site, to personalize and improve User experience, to record User preferences, and to allow Users to visit our Web site without re-entering their member ID and/or password. A cookie is a small amount of data which is sent to the User's browser from a Web site's computers and stored on the computer's hard drive. Most browsers automatically accept cookies as the default setting. Users can modify their browser setting to reject our cookies or to prompt the User before accepting a cookie by editing the browser options. However, if a browser is set not to accept cookies or if a User rejects a cookie, some portions of the Web site and services may not function properly. For example, a User may not be able to sign in and access certain Web page features or services. A Web beacon is an electronic image, also called a "gif," that may be used on our Web pages to deliver cookies, count visits and compile statistics on usage and campaign effectiveness or in our emails to tell if an email has been opened and acted upon.

Use of Personal Information

In general, we use Member personal information to process requests or transactions, to provide Members with information or services they request, to inform them about other information, events, promotions, products or services we think will be of interest to Members, to facilitate use of, and our administration and operation of, the Web site and services and to otherwise serve Members. For example, we may use personal information:

Projecis may store and process personal information in the United States and other countries. Projecis will adhere to the the General Data Protection Regulation (GDPR) privacy principles regarding the collection, use, and retention of personal information from the European Union as well as all other privacy regulations affecting the personal information of our Members.

Members will, in their use of the Services, electronically submit data or information to the Services for hosting and processing purposes ("Customer Data"). Projecis will not review, share, distribute, or reference any such Customer Data except as provided herein, or as may be required by law. In accordance with this Policy, Projecis may access Customer Data only for the purpose of providing the Services, preventing or addressing service or technical problems, at a Member's request in connection with customer support matters, or as may be required by law.

Sharing of Personal Information

Projecis reserves the right to share aggregated demographic information about our customers, sales, and traffic to our partners and advertisers. We will not give, sell, rent, share, or trade any personal information or any data that Members store using our services to any third party except as outlined in this Policy or with Member consent. We may disclose information to a third party to (a) comply with laws or respond to lawful requests and legal process, (b) to protect Projecis, agents, customers, and others including to enforce our agreements, policies and terms of use or (c) in the good faith belief that disclosure is needed to respond to an emergency or protect the personal safety of any person.

Projecis includes collaboration features that by their nature support sharing among selected Members. Those Members can see all selected Member's names, email addresses, photos and information from their profile page, and any files a Member chooses to share; and they can post comments and email to the other selected Members. Collaborators invited by a Member as editors can also edit their shared files, upload documents and photos to their shared files, share those documents outside of Projecis, and give other Members rights to view their shared files.

Projecis provides Members with opportunities to connect with third party services. If a Member chooses to use any such third party services, we may facilitate sharing of Member information and documents the Member chooses to use with those services. Use of such services is not governed by Projecis' terms or privacy policy. Projecis does not control the services of those third parties or how they use information and documents. Be sure to review the terms and the privacy policies of those third parties before using their services.

We may share personal information in connection with an acquisition, merger, or sale of all or a substantial portion of our business, with or to another company. In any such event, Members will receive notice if their data is transferred and becomes subject to a substantially different privacy policy.

Your Rights

In this Section, we have summarized the rights that you have under data protection law. Some of the rights are complex, and not all of the details have been included in our summaries. Accordingly, you should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights.

Your principal rights under data protection law are:

  1. the right to access;
  2. the right to rectification;
  3. the right to erasure;
  4. the right to restrict processing;
  5. the right to object to processing;
  6. the right to data portability;
  7. the right to complain to a supervisory authority; and
  8. the right to withdraw consent.

You have the right to confirmation as to whether or not we process your personal data and, where we do, access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Providing the rights and freedoms of others are not affected, we will supply to you a copy of your personal data. The first copy will be provided free of charge, but additional copies may be subject to a reasonable fee. You can access your personal data by visiting https://app.projecis.com/Profile when logged into our website.

You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed.

In some circumstances you have the right to the erasure of your personal data without undue delay. Those circumstances include: (i) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; (ii) you withdraw consent to consent-based processing; and (iii) you object to the processing under certain rules of applicable data protection law. However, there are exclusions of the right to erasure. The general exclusions include where processing is necessary: (i) for exercising the right of freedom of expression and information; (ii) for compliance with a legal obligation; or (iii) for the establishment, exercise or defense of legal claims.

In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: (i) you contest the accuracy of the personal data; (ii) processing is unlawful but you oppose erasure; (iii) we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defense of legal claims; and (iv) you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. However, we will only otherwise process it: with your consent; for the establishment, exercise or defense of legal claims; for the protection of the rights of another natural or legal person; or for reasons of important public interest.

You have the right to object to our processing of your personal data on grounds relating to your particular situation, but only to the extent that the legal basis for the processing is that the processing is necessary for: (i) the performance of a task carried out in the public interest or in the exercise of any official authority vested in us; or (ii) the purposes of the legitimate interests pursued by us or by a third party. If you make such an objection, we will cease to process the personal information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is for the establishment, exercise or defense of legal claims.

You have the right to object to our processing of your personal data for direct marketing purposes (including profiling for direct marketing purposes). If you make such an objection, we will cease to process your personal data for this purpose.

You have the right to object to our processing of your personal data for scientific or historical research purposes or statistical purposes on grounds relating to your particular situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

To the extent that the legal basis for our processing of your personal data is:

  1. consent; or
  2. that the processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract, and such processing is carried out by automated means, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.

If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.

To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

You may exercise any of your rights in relation to your personal data by written notice to us OR by email at support@projecis.com or by following the methods set forth in the Section below entitled “How to Withdraw Consent”.

Updating and Accessing Personal Information

If a Member's personal information changes in any way, we invite them to correct or update their information as soon as possible. Members can make updates to their profile information by logging into their account on www.projecis.com at any time. Members can also request changes or access to their information by emailing support@projecis.com.

Retaining and Deleting Personal Data

This Section sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

We will retain your personal data (First Name, Last Name, email address(es), telephone number(s) and profile photo) as follows:

  1. will be retained for a minimum period of 1 month from expiry of a free trial if a paid subscription is not created, and for a maximum period of 3 months from expiry of a free trial if a paid subscription is not created.
  2. will be retained for a minimum period of 1 month from the cancellation of a subscription and for a maximum period of 12 months from the cancellation of a subscription unless a specific time period is requested.

In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on the following criteria:

  1. delinquency of subscription payment
  2. communication with the user
  3. removal from an active subscription by the subscription administrator

Notwithstanding the other provisions of this Section, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Free Trial

If You register on our website (www.projecis.com) for a free trial, we will make one or more Services available to you on a trial basis free of charge until the earlier of (a) the end of the free trial period for which you registered to use the applicable Service(s), or (b) the start date of any purchased Service subscriptions ordered by you for such Service(s), or (c) termination by us in our sole discretion.

Additional trial terms and conditions may appear on the trial registration web page. Any such additional terms and conditions are incorporated into this Agreement by reference and are legally binding.

ANY DATA YOU OR YOUR TEAM MEMBERS ENTER INTO PROJECIS DURING YOUR FREE TRIAL WILL BE PERMANENTLY LOST AFTER 3 MONTHS OF FREE TRIAL PERIOD EXPIRY UNLESS YOU PURCHASE A SUBSCRIPTION TO THE SAME SERVICES AS THOSE COVERED BY THE TRIAL.

Setting up Your Access to Projecis

If you have set up a Free Trial or have been invited to join Projecis by an Administrator on a Projecis subscription you must accept the Terms and Conditions and the Privacy Policy in order to set up your Password and username in order to proceed with using Projecis.

By accepting the Terms and Conditions and the Privacy Policy you will be able to proceed and setup your username and password for Projecis and allowed access to the system.

If you refuse to accept the Terms and Conditions and the Privacy Policy:

  1. You will not be allowed to set up your Password and username.
  2. We may reach out to you to confirm your refusal to accept the Terms and Conditions and the Privacy Policy.
  3. Your personal information will be removed within 3 months.
  4. Removal of personal information associated with previous projects is irreversible once removed.

Withdrawal of Consent in The Future

At any time in the future you may withdraw your consent to store and process your personal information.

Upon which:

  1. You will no longer have access to Projecis.
  2. We may reach out to you to confirm your withdrawal of consent.
  3. The subscription owner may be notified of your withdrawal of consent.
  4. Unless the request for withdrawal is rescinded by you prior to removal, your personal information will be removed within 3 months of the request.
  5. Removal of personal information associated with previous projects is irreversible once removed.

Projecis may send Members communications or data regarding our Sites and Services, including but not limited to (i) notices about their use of our Sites and Services, including any notices concerning violations of use, (ii) updates, and (iii) promotional information and materials regarding our products and services. Members may opt-out of receiving promotional emails from Projecis by following the opt-out instructions provided in those emails. Members may also opt-out of receiving promotional emails and other promotional communications from us at any time by emailing support@projecis.com with a specific request. Opt-out requests will not apply to transactional service messages, such as security alerts and notices about current account and services.

How to Withdraw Consent

Submit a request indicating that you wish to withdraw consent to store and process your personal information by:

  1. Going to the following site and completing the request form:
    1. https://help.projecis.com/hc/en-us/requests/new and process your personal information.
  2. While logged into Projecis click on “?” icon on the top bar and select Feedback and Support.

Network and Information Security

Projecis takes reasonable steps to protect information we collect from Members to prevent loss, misuse and unauthorized access, disclosure, alteration, and destruction. In addition, highly confidential personal information such as credit card number and password that we request from Members on our Web site is protected with encryption, such as Secured Socket Layer (SSL) protocol, during transmission over the Internet. Card information is transmitted, stored, and processed securely on a PCI-Compliant network.

The servers on which information is stored are kept in a controlled environment with limited access. While we take reasonable efforts to guard personal information we knowingly collect directly from Users, no security system is impenetrable. In addition, we cannot guarantee that any passively-collected personal information a User chooses to include in documents they store on our systems are maintained at adequate levels of protection to meet specific needs or obligations they may have relating to that information.

Account information and access to our service is accessible only through the use of an individual Member ID and password. To protect the confidentiality of personal information, Members must keep their password confidential and not disclose it to any other person. Members should advise us immediately if they believe their password has been misused. In addition, Members should always logout and close their browser when they finish their session. Please note that we will never ask a Member to disclose their password in an unsolicited phone call or email.

All data is written to multiple disks instantly, backed up daily, and stored in multiple locations. Files that our customers upload are stored on servers that use modern techniques to remove bottlenecks and points of failure. Our servers are protected by biometric locks and round-the-clock interior and exterior surveillance monitoring. Only authorized personnel have access to the data center. 24/7/365 onsite staff provides additional protection against unauthorized entry and security breaches.

If a Member has any questions about this Policy or if a Member notices abuse, misuse or experiences an incident with their account, they should contact us at support@projecis.com.
